1. Introduction
1.1 Agreement to Terms
Welcome to GigNGo.org ("GigNGo," "we," "our," or "us"). GigNGo is a brand operated by Kickback LLC, a Michigan limited liability company, 10498 Lake Rd, Montrose, MI 48457. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and GigNGo regarding your access to and use of the website, mobile application, platform, and related services (collectively, the "Platform"). By accessing or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any provision, you must not use or access GigNGo.
IMPORTANT NOTICE — ARBITRATION AND CLASS ACTION WAIVER: Section 9 of these Terms contains a binding arbitration provision and a class action and jury trial waiver. Except as stated in Section 9, disputes between you and GigNGo will be resolved by individual binding arbitration rather than in court, and you waive the right to participate in a class action or to a trial by jury. You may opt out of arbitration within 30 days as described in Section 9.5. Please read Section 9 carefully.
1.2 Nature of the Platform
GigNGo.org is a digital marketplace that connects people seeking services ("Clients" or "Consumers") with individuals or businesses offering such services ("Locals"). The Platform facilitates communication and connection between users but does not verify or guarantee the identity, qualifications, or background of any user. GigNGo is not a party to any agreements made between Clients and Locals, nor does it control or supervise any work performed or payments exchanged between them. Users engage with one another at their own risk. The one exception is a GigNGo Job (Section 4.13): a job GigNGo itself posts and offers. For a GigNGo Job, GigNGo is a party to the job with the Local who accepts it, as Section 4.13 describes.
1.3 Independent Contractors
All Locals using GigNGo are independent contractors and not employees, agents, or representatives of GigNGo. The Platform does not employ, endorse, or manage any Local or guarantee the outcome of any services provided. A Local who accepts a GigNGo Job (Section 4.13) remains an independent contractor for that job.
1.4 Updates to These Terms
GigNGo reserves the right to modify or update these Terms at any time. Any changes will take effect upon being posted on the Platform with a new "Last Updated" date. We may also notify users by email, text, push notification, or in-platform notifications. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
1.5 Text Messages (SMS)
GigNGo, operated by Kickback LLC, sends text messages only to people who give us their mobile number and agree to receive them: a homeowner who adds a number when posting a job, or anyone who ticks the unchecked "Text me GigNGo alerts" box when signing up. Messages are about your own activity on GigNGo, such as a local offering on your job, a reply to your request, or a job posted near you. Message frequency varies; you will not receive more than 3 texts a day or 10 a week. Message and data rates may apply. Reply STOP to any text to stop receiving them, or HELP for help, or write to [email protected]. Agreeing to texts is never a condition of using GigNGo. Carriers are not liable for delayed or undelivered messages.
2. Account Registration and Eligibility
2.1 Account Creation
Users may browse the Platform freely without registering an account. However, to post jobs, apply for work, upload videos, send messages, or hire through GigNGo, you must create an account and provide accurate and up-to-date information. You agree to keep your login credentials secure and are responsible for all activity that occurs under your account. GigNGo is not liable for unauthorized account access resulting from your failure to maintain security.
2.2 Eligibility Requirements
To create an account or use GigNGo's services, you must be at least 18 years old and capable of entering into legally binding agreements. By using the Platform, you represent and warrant that you meet these eligibility requirements. This age restriction applies to all features, including video uploads, messaging, and service transactions.
2.3 Business and Individual Accounts
Both individuals and businesses may use GigNGo. Account features, visibility, and pricing may vary depending on the type of plan selected. GigNGo may request additional information from businesses to verify legitimacy before activating or displaying listings.
2.4 Account Termination and Suspension
GigNGo reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent or illegal behavior, or otherwise disrupts the Platform's integrity. We may also remove listings, videos, or content at our discretion. Termination of your account does not entitle you to any refund or credit, except where required by law.
3. Subscription Plans and Payments
3.1 Subscription Options
GigNGo offers several subscription tiers for Locals, providing varying levels of visibility, listing features, and application limits. Each plan includes a certain number of credits, which are used each time a Local applies to a posted job. Credits help prevent spam and ensure motivated applicants.
3.2 Billing, Renewal, and Free Trials
Plans are billed monthly or yearly, at the price shown before you buy. Payments made on our website or Android app are processed by Stripe (for example, by card, Cash App Pay, or Link). Plans bought in the iPhone app are billed by Apple, and Apple's terms apply to that billing. By subscribing, you authorize GigNGo and its payment processor to charge your payment method for each billing period until you cancel. Every plan renews automatically at the end of each billing period unless you cancel before then.
- Free trials: If a plan offers a free trial, the length of the trial and the price you will be charged after it are shown before you start. A trial needs a saved payment method. When the trial ends, you are charged that price and the plan renews from then on, unless you cancel before the trial ends. If you cancel during the trial, you are not charged.
- Introductory prices: A plan may offer a lower price for its first period. The introductory price, how long it lasts, and the regular price after it are shown before you buy.
- Price changes: If the price of a plan you already have changes, we will tell you before it applies to you.
3.3 Cancellation Policy
You may cancel at any time. For a plan billed through GigNGo, cancel in the app under Manage Subscription or on our website; for a plan bought through Apple, cancel in your Apple ID subscription settings. When you cancel, your plan stays active until the end of the period you have already paid for and is not renewed after that. GigNGo does not provide refunds for the unused part of a billing period once it has begun.
3.4 No Refunds
All subscription payments are final and nonrefundable, except where prohibited by law. Users are responsible for managing their subscription renewals and cancellations prior to the next billing date.
3.5 Payment Disputes
Because GigNGo does not process or oversee payments between Clients and Locals, we are not responsible for disputes, refunds, damages, or failed payments that occur between users. Any payment-related disagreements must be resolved directly between the involved parties. This section does not apply to pay for a GigNGo Job, which GigNGo owes you as described in Section 4.13.
3.6 Credit System
Locals receive a monthly allocation of application credits based on their subscription tier. Credits are consumed when applying to posted jobs. The credit system operates as follows:
- Credit Allocation: Applying to jobs needs a paid plan or a bonus credit. A free account can make a profile, post videos, and post jobs, but includes no monthly applications. Each paid plan shows how many applications it includes on the Plans screen before you buy; some plans include unlimited applications, and on those no credit is counted. Bonus credits (for example, from the referral program in Section 3.8) can be used whether or not you have a paid plan.
- Credit Usage: One credit is deducted for each job application submitted.
- Monthly Reset: Credits reset on your subscription anniversary date each month (the same day of the month you started your subscription).
- No Rollover: Unused credits do not carry over to the next billing cycle.
- No Refunds: Credits are non-refundable and have no cash value.
- No Transfers: Credits cannot be transferred between accounts or sold to other users.
- No Guarantee of Response or Hire: Submitting a job application and consuming a credit does not guarantee a response, interview, or hire from the Client. Clients are under no obligation to respond to, review, or accept any application. GigNGo is not responsible for Clients who do not respond or who select a different Local. Credits are consumed upon submission regardless of outcome.
- GigNGo Jobs Are Free to Apply To: Applying to, or accepting an invitation to, a GigNGo Job (Section 4.13) never uses a credit and never requires a paid plan.
- Application Limits Are Per Submission: Each application to a unique job posting consumes one credit. Withdrawing or resubmitting an application to the same posting may consume additional credits.
3.7 Boosts and Featured Placement
GigNGo offers paid ways to make a job post or a Local's profile more visible, such as boosting a job post for a set time or a monthly Profile Boost. GigNGo may also give boosts or featured placement for free, for example as a thank-you or reward. These operate as follows:
- Price and length: Before you buy, the price, how long the extra visibility lasts, and whether it is a one-time purchase or a monthly subscription are shown.
- Subscriptions: A boost sold monthly renews and can be cancelled as described in Sections 3.2 and 3.3.
- No Refunds: One-time boosts are final and nonrefundable once active, except where the law requires otherwise.
- No Guarantee of Results: A boost increases where a post or profile is shown. It does not guarantee views, applications, messages, or hires.
- Expiration: A boost ends on its own when its time is up.
3.8 Referral Program
GigNGo offers a referral program that rewards users for bringing new people to the Platform. It operates as follows:
- Referral Links: Each user has a personal referral link that can be shared anywhere.
- Rewards for both people: A person who signs up through your link may get a welcome reward. You may get a reward once that person takes a first real step on GigNGo, such as posting a job or applying to one. Rewards are credits on GigNGo, such as a bonus application credit for a Local or a boost credit for someone who posts jobs.
- Eligibility: Rewards are given only for real new people. Self-referrals, fake accounts, and fraudulent signups do not qualify.
- Non-Transferable: Referral credits cannot be transferred between accounts, exchanged for cash, or sold.
- Program Changes: GigNGo may change, pause, or end the referral program at any time. Rewards already given are kept.
- Fraud Prevention: Abuse of the referral program (including fake accounts or bots) may result in losing credits and account suspension.
3.9 Big Jobs
GigNGo has a feature, called "Big Jobs," that can limit applications to high-value jobs on some plans. It is currently switched off: on any paid plan you can apply to, and quote, a job of any size. If GigNGo turns it on again, the Plans screen will show which plans it affects and their limits before you buy, and GigNGo will tell you before it affects a plan you already have.
3.10 Creator Program
GigNGo pays approved creators a commission for Locals they bring to a paid GigNGo membership. The program is separate from the referral program in Section 3.8 and operates as follows:
- Approval: You join by applying at gigngo.org/creators. GigNGo decides whether to approve an application, and approved creators get their own link.
- Commission: A creator earns a share of each membership payment made by a person who signed up through their link, for 12 months from that person's first payment. The current rates are shown at gigngo.org/creators when you join. An individual creator agreement may set a higher rate.
- What does not count: Payments by your own account, payments that are refunded or disputed, and any payment GigNGo determines was obtained through fraud. If a payment is refunded or disputed after you were paid for it, that amount is taken back from a later payout.
- Payouts: Commissions are paid to your bank through Stripe, after a holding period after each payment. Stripe collects your bank and tax details and issues tax forms such as a 1099 where the law requires. You must finish Stripe's setup to be paid.
- Disclosure: When you share your link, you must say clearly that you are paid if people join (for example, with #ad), as the Federal Trade Commission requires.
- Changes: GigNGo may change the program's rates or rules for payments made after the change, or end the program, and will tell approved creators before a change applies to them. Commission already earned is still paid.
4. Use of the Platform
4.1 Permitted Use
The Platform may be used only for lawful purposes and in accordance with these Terms. Users agree to comply with all applicable federal, state, and local laws and regulations when using GigNGo.
4.2 Prohibited Activities
Users must not:
- Post or request illegal, unsafe, or inappropriate services.
- Impersonate another person or misrepresent affiliation with any entity.
- Engage in harassment, spam, discrimination, or hate speech.
- Circumvent subscription limits, manipulate ratings, or misuse messaging features.
- Upload harmful code, viruses, malware, or automated bots that disrupt the Platform's function.
- Scrape, crawl, or use automated tools to extract data from the Platform.
- Attempt to gain unauthorized access to any part of the Platform or other users' accounts.
- Use the Platform to distribute unsolicited commercial messages or advertisements.
GigNGo may suspend or terminate accounts that engage in prohibited activities without prior notice.
4.3 Direct Communication
Depending on plan type, users may exchange direct contact information (such as phone numbers or social links) or communicate via the in-app messaging system. Users are responsible for their own safety and discretion when sharing personal information.
4.4 Reporting and Enforcement
Content that is illegal, fraudulent, misleading, or unrelated to the Platform's purpose may be reported by users or removed by GigNGo at our sole discretion. Repeated violations may result in account suspension or permanent removal.
4.5 Video Content and Inspiration Feed
GigNGo provides a video-based inspiration feed ("GigFeed" or "Watch Feed") where Locals can upload and share videos showcasing their skills, completed projects, and services. By uploading videos, you agree to the following:
4.5.1 Video Upload Requirements
- Age Restriction: You must be at least 18 years old to upload videos.
- File Format: Videos must be in MP4, MOV, or WebM format.
- File Size: The app tells you if a video is too large to upload.
- Duration: Videos must be between 5 seconds and 3 minutes in length.
- Content Quality: Videos should be clear, relevant, and professionally representative of your services.
4.5.2 Content Guidelines
Videos must not contain:
- Illegal activities or content promoting illegal behavior.
- Nudity, sexual content, or sexually suggestive material.
- Violence, graphic content, or content that promotes harm.
- Hate speech, harassment, bullying, or discriminatory content.
- Copyrighted material you do not have rights to use (music, images, video clips).
- Misleading or deceptive content about services or qualifications.
- Spam, irrelevant content, or excessive promotional material.
- Personal information of others without their consent.
4.5.3 Video Hosting and Processing
- Videos are uploaded to and hosted by Cloudflare Stream, a third-party video hosting service.
- GigNGo automatically generates thumbnails from your uploaded videos.
- Videos are transcoded into multiple formats and resolutions for optimal playback.
- Video processing may take several minutes; videos will appear in your profile once processing is complete.
4.5.4 License Grant for Videos
By uploading a video to GigNGo, you grant GigNGo a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Host, store, and display your video on the Platform.
- Create thumbnails, previews, and derivative works from your video.
- Distribute your video through content delivery networks (CDNs).
- Use your video in marketing, promotional, and advertising materials.
- Transcode your video into multiple formats, resolutions, and bitrates.
- Display your video in search results, recommendations, and category feeds.
This license survives termination of your account for videos that have been shared, embedded, or distributed prior to termination.
4.5.5 Content Moderation
GigNGo reserves the right to:
- Review, moderate, and approve videos before they appear publicly.
- Remove, hide, or flag videos that violate these Terms or community guidelines.
- Suspend or terminate accounts that repeatedly upload prohibited content.
- Use automated systems and AI to detect inappropriate or illegal content.
- Respond to copyright infringement claims under the DMCA (see Section 11).
4.5.6 Video Analytics
GigNGo tracks video engagement metrics including view count, like count, share count, watch time, completion rate, and geographic distribution of viewers. These metrics may be visible to you and, in some cases, to other users.
4.6 Booking and Quote Requests From Videos
Locals may let homeowners reach them straight from their videos. This feature operates as follows:
4.6.1 Local Settings
- Locals can turn on or off whether homeowners may book them or ask for a quote from their videos, in their account settings.
- A homeowner sees the option to book a Local only when the homeowner is within that Local's service area and the Local has these settings on.
4.6.2 What the Homeowner Does
- The option opens a short job form, filled in from the video, that the homeowner can change before sending.
- The request goes to that Local through GigNGo. Homeowners outside a Local's area can post the job openly for nearby Locals instead.
4.6.3 No Guarantee of Response
GigNGo does not guarantee that locals will respond to requests. Locals are not obligated to provide quotes or accept jobs. Requests are subject to locals' availability and preferences.
4.7 Sharing Job Posts Beyond GigNGo
To help a job reach Locals who can do it, GigNGo may share open job posts beyond the app. By posting a job on GigNGo, you agree to the following:
4.7.1 Where a Job May Appear
- A public page for the job on gigngo.org (for example, gigngo.org/jobs/...), which search engines, including Google's job listings, may show.
- Job boards and listing services that receive GigNGo's job listings.
- Links shared by you or by others, such as in local community groups.
4.7.2 What Is Shared
- The job's title, description, type of work, and town and state.
- GigNGo is named as the poster. Your name, street address, ZIP code, phone number, and email address are not shown, and contact details typed into a description are removed.
- Every listing links back to GigNGo, where Locals offer and you reply.
4.7.3 Removal
- When a job is filled, expires, or is removed on GigNGo, its public page is marked closed and dropped from GigNGo's listings and job feeds.
- You may ask for a job's public page to be taken down by writing to [email protected].
- GigNGo is not responsible for cached or archived copies kept by search engines or other sites.
4.8 SMS Communications and TCPA Compliance
GigNGo texts you only if you have said yes to texts, as described in Section 1.5. Giving us a phone number, by itself, is not a yes. These terms apply to every text we send:
4.8.1 How you say yes
- Ticking the unchecked "Text me GigNGo alerts" box when you sign up.
- Adding your mobile number to a job you post, to hear about that job by text.
- Switching texts on in your settings.
- Replying START to a GigNGo text number.
Agreeing to texts is never a condition of using GigNGo or of buying anything.
4.8.2 What we text
- Messages about your own activity on GigNGo only: for example, a local offering on your job, a reply to your request, an update on a job you offered on, or a job posted near you.
- GigNGo does not send marketing or promotional texts.
- Account security codes (such as a sign-in code you request) are sent when you ask for them.
4.8.3 Limits, hours, and stopping
- No more than 3 texts a day or 10 a week.
- Texts are sent only between 8 AM and 9 PM in your local time. A text that would arrive outside those hours waits until morning.
- Reply STOP to any text to stop all GigNGo texts, or switch texts off in your settings. Reply HELP for help, or write to [email protected]. If you say yes again later (for example, by replying START), texts resume.
- Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- GigNGo complies with the Telephone Consumer Protection Act (TCPA) and applicable state laws on text messages.
4.8.4 Text Message Provider
Texts are sent through Twilio, a third-party communications platform. Your phone number is shared with Twilio only to deliver messages. Twilio's privacy practices are governed by its privacy policy: https://www.twilio.com/legal/privacy
4.9 Following System
Users may follow other users on GigNGo to receive updates about their activity, new videos, and service offerings. The following system operates as follows:
- Who you follow is not hidden from the person you follow. Follower and following counts may be shown to other users.
- You may unfollow any user at any time.
- Following does not grant access to private information or direct messaging privileges beyond what your subscription allows.
- GigNGo reserves the right to limit following activity to prevent spam or abuse.
4.10 Scheduling and Calendar Features
GigNGo provides scheduling tools within the messaging system to help Clients and Locals coordinate service appointments:
- Scheduling Suggestions: AI-powered suggestions for meeting times based on conversation context.
- Add to Calendar: Users can add scheduled appointments to their device calendar (Google Calendar, Apple Calendar, etc.).
- Calendar integration requires your device's permission and may share appointment details with your calendar provider.
- GigNGo does not guarantee appointment fulfillment or enforce scheduled times between users.
4.11 Google Business and Social Account Connections
Locals may connect third-party accounts to enhance their GigNGo profiles:
- Google Business Profile: Connect your Google Business Profile to import business details, reviews, and verification status.
- Facebook Page: Connect your Facebook Page to import business information and reviews.
- Connecting third-party accounts requires OAuth authorization. GigNGo accesses only the information you authorize and does not post to your accounts without your permission.
- You may disconnect third-party accounts at any time through your account settings.
- Imported data is subject to GigNGo's Terms and Privacy Policy.
4.12 Review Import
Locals may import reviews from external platforms (such as Google Business or Facebook) to display on their GigNGo profile:
- Imported reviews are clearly labeled as originating from external sources.
- GigNGo does not verify the authenticity of imported reviews and is not responsible for inaccurate or fraudulent external reviews.
- Locals are responsible for ensuring they have the right to display imported reviews on GigNGo.
- GigNGo reserves the right to remove imported reviews that appear fraudulent, misleading, or in violation of these Terms.
4.13 GigNGo Jobs
Most jobs on GigNGo are posted by homeowners and other users. GigNGo also posts jobs of its own. These "GigNGo Jobs" are marked as coming from GigNGo (for example, "From GigNGo"). The following applies to every GigNGo Job:
4.13.1 Who is offering the job
- A GigNGo Job is offered by GigNGo (Kickback LLC). GigNGo may post it for its own purposes, or to carry out work for a business or organization that has an agreement with GigNGo (a "Business Client").
- A Business Client may or may not be named in the job. Either way, GigNGo is the party offering the job to you.
4.13.2 Invitations
- GigNGo may choose Locals it believes fit a GigNGo Job and invite them directly. GigNGo chooses based on information on the Platform, such as trade, location, profile, videos, and past jobs.
- Invitations may arrive in the app, by push notification, by email, or by text message if you have agreed to receive texts (Section 1.5).
- Whether you are invited is GigNGo's decision. It is not a rating of you or your work. You may decline or ignore any invitation, and doing so has no effect on your account.
- A GigNGo Job may also be posted openly for any nearby Local to apply.
4.13.3 No cost to you
- Applying to or accepting a GigNGo Job is free. It never uses a credit and never requires a paid plan.
- GigNGo does not take any part of the pay stated for a GigNGo Job. GigNGo may separately charge a Business Client for its own services.
4.13.4 The terms of each job
- Before you accept, each GigNGo Job states the work, the place, the timing, the pay, and any requirements.
- When you accept, you and GigNGo agree to do and pay for that job on those stated terms and these Terms.
- If the job is paid, GigNGo pays you the stated amount once the work is confirmed done, through its payment provider (for example, Stripe). Your pay does not depend on whether a Business Client pays GigNGo.
- You may be asked for tax information (such as a W-9) before you are paid. GigNGo will issue tax forms such as a 1099 where the law requires.
- If GigNGo cancels a job after you have started, it pays for the work you have done, or any cancellation amount the job states.
- Some GigNGo Jobs are unpaid, such as kindness jobs. Any reward for an unpaid job is described in the job itself.
4.13.5 You remain independent
- You are an independent contractor, not an employee of GigNGo or of any Business Client.
- You decide how to do the work and use your own tools and judgment, within the scope, place, and time window the job states.
- You may turn down any GigNGo Job, and you are free to work for anyone else, on or off GigNGo.
4.13.6 Requirements
- A GigNGo Job may require something specific, such as proof of insurance, a license where the law requires one, or a background check. Any requirement is stated in the job before you accept.
- A background or identity check is done only with your consent, and the job says who orders it. Apart from a check a job states, GigNGo does not check Locals (Section 6.3).
4.13.7 Photos and video of the work
- A GigNGo Job may ask you to photograph or film the work as a record that it was done. The job says who will see that record, which may include the Business Client.
- You film only with the agreement of the person whose property it is, and never anyone who has not agreed.
- That record is not posted publicly unless you, and the property's owner or occupant, separately agree.
4.13.8 What is shared with a Business Client
- When you accept a GigNGo Job for a Business Client, GigNGo may share with that Business Client what is needed to carry out the job. That may include your name, your public profile and videos, your arrival time, and the job's completion record.
- GigNGo does not share your phone number or email address with a Business Client unless the job requires it and you agree.
4.13.9 Responsibility for the work
- You are responsible for doing the work safely, lawfully, and as described in the job.
- Sections 6 and 7 apply to GigNGo Jobs, except where this Section 4.13 says otherwise.
5. User Content and Intellectual Property
5.1 Ownership of User Content
Users may upload or post materials such as job listings, service descriptions, photos, videos, portfolios, reviews, and profile information (collectively, "User Content"). While you retain ownership of the original materials you submit, you grant GigNGo.org a perpetual, worldwide, royalty-free, transferable license to use, host, display, distribute, modify, and reproduce such content for purposes related to operation, marketing, SEO visibility, and promotion of the Platform. This license survives termination of your account.
5.2 Platform Ownership
All intellectual-property rights in the Platform—including but not limited to its design, functionality, features, code, text, graphics, trademarks, and logos—are owned or licensed by GigNGo.org. You may not copy, modify, distribute, reverse-engineer, or otherwise exploit any part of the Platform except as expressly permitted by these Terms.
5.3 Visibility After Account Deletion
When a user deletes an account, related public listings may remain visible in search results or directories for a limited time due to caching, indexing, or SEO purposes. Portfolios, reviews, and other personal data will be deleted or anonymized as practical. GigNGo reserves the right to retain minimal data for legitimate business, recordkeeping, or legal reasons.
5.4 Third-Party Links and Portfolios
Users may include external links (for example, to Instagram, YouTube, or other portfolios) within the "Connect" or profile sections. GigNGo is not responsible for any content, data collection, or availability on those external websites. Accessing external links is entirely at your own risk.
5.5 AI-Powered Features
GigNGo uses artificial intelligence and machine learning technologies to enhance the Platform experience. These AI-powered features include:
5.5.1 AI Categorization
- Task Categorization: AI automatically categorizes work requests into appropriate service categories based on job descriptions.
- Video Categorization: AI analyzes video content to suggest appropriate categories, tags, and keywords.
- Skill Matching: AI helps match locals with relevant job opportunities based on their profiles and past work.
5.5.2 Illegal Content Detection
- GigNGo employs automated systems to detect potentially illegal or prohibited content in job postings, messages, and video uploads.
- Content flagged by AI systems may be blocked immediately or held for manual review.
- Detection systems scan for keywords and patterns associated with illegal drugs, weapons, stolen goods, fraud, human trafficking, violence, and other prohibited activities.
- The system supports multiple languages including English and Spanish.
5.5.3 AI Pricing Suggestions
- Price Estimates: GigNGo may use AI to generate suggested price ranges for job postings based on category, location, complexity, and historical data.
- Advisory Only: AI-generated pricing is provided as a suggestion only and does not constitute a binding quote, guarantee of cost, or professional appraisal.
- No Liability: GigNGo is not responsible for pricing decisions made by users based on AI suggestions. Final pricing is always determined by the Client and Local.
5.5.4 AI Limitations and Disclaimers
- AI systems are not perfect and may produce false positives or miss prohibited content.
- GigNGo does not guarantee the accuracy of AI categorization or content detection.
- Users may appeal AI decisions by contacting [email protected].
- Final decisions on content moderation are made by GigNGo staff.
- GigNGo does not use your content to train AI models or sell data to third parties for AI training purposes.
5.5.5 AI Transparency Disclosure (FTC)
Consistent with Federal Trade Commission (FTC) guidance on the truthful and transparent use of artificial intelligence, GigNGo discloses the following:
- Disclosure of AI Involvement: Where content, suggestions, or estimates presented to you are generated or materially assisted by AI (for example, AI pricing suggestions, AI-suggested categories or tags, or AI-drafted communications), GigNGo will identify them as AI-generated or AI-assisted, or present them in a context that makes their automated nature clear.
- Automated Interactions: If you interact with an automated system (such as an AI assistant or automated support response) rather than a human, GigNGo will not misrepresent that system as a human.
- No Fake or AI-Generated Reviews: GigNGo does not create, purchase, or publish fake or AI-generated consumer reviews or testimonials, consistent with the FTC's Rule on the Use of Consumer Reviews and Testimonials (16 C.F.R. Part 465). Reviews on the Platform are submitted by users; imported reviews are labeled with their external source (see Section 4.12).
- No Overstated Capabilities: GigNGo does not represent that its AI features are error-free or a substitute for professional judgment. AI outputs are informational aids only and may be inaccurate or incomplete (see Section 5.5.4).
- Human Recourse: You may appeal or request human review of any AI-driven decision that affects your account or content by contacting [email protected].
5.6 Location Services and Privacy
GigNGo uses location data to connect users with nearby services and opportunities. To protect user privacy, we implement location fuzzing:
5.6.1 Location Fuzzing Methodology
- When locals set their location for notifications and map display, their exact coordinates are stored securely but never displayed publicly.
- A random offset between 0.2 and 0.8 miles is applied when displaying local locations on maps.
- The offset distance and direction are randomized each time the map loads.
- This prevents users from determining a local's exact home or business address.
5.6.2 Signup Location Data
When you create an account, GigNGo automatically detects and permanently records your city and state at the time of registration. This data is used to:
- Monitor marketplace health and ensure adequate coverage of locals and consumers in each geographic area.
- Identify underserved locations where additional outreach or recruitment may be needed.
- Generate aggregated geographic distribution reports for internal platform analytics.
This signup location is stored separately from your editable profile location and is not publicly visible. By creating an account, you consent to this data collection as described in our Privacy Policy.
5.6.3 Exact Location Usage
- Exact coordinates are used server-side for accurate proximity calculations (e.g., determining which locals are near a posted job).
- Push notifications include accurate distance calculations based on exact coordinates.
- Exact coordinates are never shared with other users or displayed in the user interface.
5.6.4 User Control
- Locals can view their exact coordinates in their profile settings.
- Locals can update or remove their location at any time.
- Locals can disable location-based notifications in their settings.
- Deleting your account permanently removes all location data.
5.7 Satellite Domains and Multi-Domain Operation
GigNGo operates across multiple domains to improve discoverability and serve users through various branded experiences. These domains include but are not limited to:
- gigngo.org (primary domain)
- giggo.org
- gigmarketplace.org
- gigsmarket.org
- gigsmarketplace.org
- jobmarketplace.org
- workmarketplace.org
By using GigNGo, you acknowledge and agree that:
- Your public profile, listings, videos, and reviews may appear on any of these domains.
- All domains share the same underlying platform, database, and user accounts.
- These Terms and our Privacy Policy apply equally across all GigNGo-operated domains.
- GigNGo may add or remove satellite domains at any time without prior notice.
5.8 Search Engine Indexing and Auto-Indexing
GigNGo proactively submits public user content to search engines to improve discoverability and help Locals attract Clients. This includes:
- Server-Side Rendering (SSR): Local profiles are rendered server-side to enable rich search engine previews with your name, photo, title, bio, and service area.
- IndexNow Submissions: When you create or update your profile, GigNGo may submit your public profile URL to search engines (including Bing and Yandex) via the IndexNow protocol for faster indexing.
- Automatic Indexing: Public profiles are automatically included in our sitemap and submitted to Google Search Console for indexing.
- Opt-Out: If you do not want your profile indexed by search engines, you may contact [email protected] to request exclusion. Note that deleting your account automatically removes your profile from our sitemap, though cached copies may persist in search engine results until refreshed.
6. Liability and Disclaimers
6.1 Platform "As-Is"
The GigNGo Platform is provided on an "as-is" and "as-available" basis. We make no warranties or representations of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, reliability, availability, or non-infringement. We do not guarantee that the Platform will always function without disruptions, delays, or errors.
6.2 Marketplace Disclaimer
Except for GigNGo Jobs, where GigNGo is a party as described in Section 4.13, GigNGo is a connection service only. We do not employ, endorse, or control Locals or Clients. We are not responsible for, and make no representations regarding, the quality, timing, legality, pricing, or safety of any services performed or received. All transactions, communications, and work performed are strictly between the involved users.
6.3 User Responsibility
You acknowledge that you are solely responsible for conducting any background checks, verifying identities, reviewing qualifications, and ensuring compliance with laws before hiring or performing services. GigNGo assumes no responsibility for verifying such information or for any damages arising from user interactions. For a GigNGo Job, GigNGo chooses which Locals to invite (Section 4.13.2), but it still does not run background checks unless the job states one is required (Section 4.13.6).
6.4 Video Content Liability
GigNGo is not responsible for user-generated video content uploaded to the Platform. Users who upload videos are solely responsible for:
- Ensuring they own or have proper licenses for all content in their videos (including music, images, and video clips).
- Ensuring videos do not infringe on any third-party copyrights, trademarks, or other intellectual property rights.
- Ensuring videos comply with all applicable laws and regulations.
- Any claims, damages, or legal actions arising from their uploaded videos.
GigNGo operates as a service provider under the Digital Millennium Copyright Act (DMCA) and is protected by safe harbor provisions for user-generated content (see Section 11).
6.5 Third-Party Services
The Platform integrates with various third-party services including Firebase and Google Cloud (including Google Gemini), Cloudflare (including Cloudflare Stream), OneSignal, PostHog, Sentry, Anthropic, OpenAI, Sightengine, SendGrid, Twilio, SerpApi, Yelp, Stripe, PayPal, Apple, Google Play, and others. GigNGo is not responsible for the availability, functionality, security, or privacy practices of these third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
6.6 User-Generated Content Liability and Takedown
All User Content — including job postings, profiles, bios, photos, videos, reviews, and messages — is the sole responsibility of the user who posted it. GigNGo is a provider of an interactive computer service within the meaning of Section 230 of the Communications Decency Act (47 U.S.C. § 230) and is not the publisher or speaker of User Content. User Content does not represent the views of GigNGo, and GigNGo does not endorse any User Content.
- No Duty to Prescreen: GigNGo has no obligation to pre-screen, monitor, or edit User Content, though it may do so through automated and manual moderation (see Section 12).
- Right to Remove: GigNGo reserves the right (but not the obligation) to remove, restrict, or disable access to any User Content at any time, at its sole discretion, without prior notice, including content that is illegal, infringing, fraudulent, harassing, or otherwise violates these Terms.
- Takedown Requests: To request removal of content that infringes your copyright, follow the DMCA procedure in Section 11. To report any other unlawful, defamatory, private, or otherwise objectionable content, use the in-app "Report" feature or email [email protected] with the content's location and the reason for the request (see Section 12.5). GigNGo will review takedown requests and act as it deems appropriate, but does not guarantee removal of content that does not violate these Terms or applicable law.
- No Liability for User Content: To the maximum extent permitted by law, GigNGo is not liable for any User Content, including any errors, omissions, defamation, infringement, or damages of any kind arising from content posted by users or from GigNGo's decision to remove or not remove content.
6.7 Weather Alerts Disclaimer
The Platform may provide weather safety alerts and post-event "storm checkup" recovery suggestions based on your saved home location, using public data from the U.S. National Weather Service (NWS). These features are provided for general informational and convenience purposes only. They are not an official warning system and are not a substitute for the National Weather Service, local emergency management, or other official sources. We do not guarantee that any alert will be sent, will be timely, or will be accurate or complete, and you should never rely on the Platform for life-safety decisions. Always follow official guidance from local authorities and the National Weather Service during severe weather. GigNGo is not liable for any loss, damage, or injury arising from your reliance on, or the absence or delay of, any weather alert or recovery suggestion.
7. Limitation of Liability and Indemnification
7.1 Limitation of Liability
To the maximum extent permitted by law, GigNGo and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, data, or other intangible losses arising out of or related to the use of the Platform.
If, notwithstanding the foregoing, GigNGo is found liable to you for any damages, such liability shall in no event exceed the total amount paid by you (if any) to GigNGo in the twelve (12) months preceding the event giving rise to the claim. This limit does not reduce any pay GigNGo owes you for a GigNGo Job you completed (Section 4.13.4).
7.2 Indemnification
You agree to defend, indemnify, and hold harmless GigNGo, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from or related to:
- Your use or misuse of the Platform.
- Your violation of these Terms.
- Your violation of any rights of another user or third party.
- Your content or conduct, including videos, job postings, messages, and reviews.
- Copyright infringement claims related to your uploaded videos or other content.
- Any services you provide or receive through the Platform.
8. Termination of Use
8.1 By the User
You may stop using the Platform or delete your account at any time through your profile settings. Deletion is permanent and may result in loss of stored information or listings.
8.2 By GigNGo
GigNGo reserves the right to suspend or terminate any account or access to the Platform at any time and for any reason, including violation of these Terms, illegal conduct, copyright infringement, or harm to other users or the reputation of the Platform.
8.3 Effect of Termination
Upon termination, all rights granted to you under these Terms will immediately cease. Any provisions that, by their nature, should survive termination (including ownership, warranty disclaimers, limitation of liability, and indemnification) will remain in effect.
8.4 Content Retention After Termination
- Most user content (profiles, listings, reviews) will be deleted upon account termination.
- Videos may remain temporarily in CDN caches or search engine indexes until refreshed.
- Messages may be retained for up to 60 days for fraud prevention and legal compliance.
- GigNGo may retain minimal data as required by law or for legitimate business purposes.
9. Governing Law and Dispute Resolution
9.1 Governing Law
These Terms and any disputes arising from or relating to your use of the Platform shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict-of-law principles.
9.2 Binding Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved informally by contacting [email protected]. Each party agrees to negotiate in good faith for at least thirty (30) days before initiating arbitration.
If unresolved, the dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. This agreement to arbitrate is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.). Arbitration shall take place in Michigan, in the county where you reside, or by telephone or videoconference, as permitted by the AAA rules, unless both parties agree otherwise. The arbitrator shall have exclusive authority to resolve all disputes arising out of or relating to these Terms, including the scope and enforceability of this arbitration provision (except as provided in Section 9.4). The arbitration award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Payment of filing, administration, and arbitrator fees will be governed by the AAA's Consumer Arbitration Rules; each party otherwise bears its own costs unless the arbitrator determines otherwise.
9.3 Small-Claims and Injunctive Relief
Nothing in this section prevents either party from seeking resolution in small-claims court for disputes within that court's jurisdiction, or requesting injunctive or equitable relief for violations of intellectual-property rights or unauthorized use of the Platform.
9.4 Class Action and Jury Trial Waiver
YOU AND GIGNGO EACH AGREE THAT ANY DISPUTE WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION OR PROCEEDING. YOU AND GIGNGO EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class, collective, or representative proceeding. Only a court, and not the arbitrator, may determine the enforceability of this Section 9.4. If this class action waiver is found unenforceable as to a particular claim, then that claim (and only that claim) shall proceed in court rather than in arbitration, and the remainder of this Section 9 shall continue to apply.
9.5 Arbitration Opt-Out
You may opt out of the arbitration provision and class action waiver in Sections 9.2 and 9.4 by emailing [email protected] with the subject line "Arbitration Opt-Out" within thirty (30) days of first creating your account (or, for existing users, within thirty (30) days of the "Last Updated" date of the version of these Terms that first included this provision). Your opt-out notice must include your full name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration does not affect any other provision of these Terms. If you opt out, disputes will be resolved exclusively in the state or federal courts located in Michigan, and both parties consent to the personal jurisdiction of those courts.
10. Miscellaneous Provisions
10.1 Entire Agreement
These Terms constitute the entire agreement between you and GigNGo concerning your use of the Platform and supersede all prior agreements or understandings, whether written or oral.
10.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10.3 Waiver
Failure by GigNGo to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision in any instance.
10.4 Assignment
You may not assign or transfer these Terms or any rights or obligations herein without prior written consent from GigNGo. We may assign our rights or obligations under these Terms at any time without notice.
10.5 Notices
Notices required or permitted under these Terms may be sent by email to [email protected] or through any other method of communication we provide on the Platform.
11. Digital Millennium Copyright Act (DMCA)
11.1 Copyright Policy
GigNGo respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512).
11.2 DMCA Takedown Procedure
If you believe that your copyrighted work has been uploaded to GigNGo without authorization, you may submit a DMCA takedown notice to our designated agent:
Designated DMCA Agent:
Email: [email protected]
Subject Line: "DMCA Takedown Notice"
Your notice must include:
- A physical or electronic signature of the copyright owner or authorized representative.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, including URL or specific location on the Platform.
- Your contact information (name, address, telephone number, email address).
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
11.3 Counter-Notification
If your content was removed due to a DMCA takedown notice and you believe the removal was erroneous, you may submit a counter-notification to [email protected].
Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed by mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Michigan if outside the U.S.), and that you will accept service of process from the person who filed the original DMCA notice.
11.4 Repeat Infringer Policy
GigNGo will terminate the accounts of users who are determined to be repeat copyright infringers. A repeat infringer is a user who has been notified of infringing activity more than twice or has had content removed from the Platform more than twice.
11.5 False Claims
Submitting a false or fraudulent DMCA notice or counter-notification may result in legal liability. You may be liable for damages, including costs and attorney's fees, if you materially misrepresent that content is infringing or was removed by mistake.
12. Content Moderation and Enforcement
12.1 Automated Moderation
GigNGo uses automated systems, including artificial intelligence, to detect and prevent prohibited content from appearing on the Platform. These systems scan job postings, video uploads, messages, and user profiles for illegal services, inappropriate content, harassment, spam, or fraudulent information.
12.2 Manual Review
Content flagged by automated systems or reported by users may be reviewed manually by GigNGo staff. Manual review may result in content removal, account warnings, account restrictions, account suspension, account termination, or reporting to law enforcement (for illegal activity).
12.3 Enforcement Actions
GigNGo may take the following enforcement actions for Terms violations:
- Warning: First-time or minor violations may result in a warning.
- Content Removal: Specific content (posts, videos, messages) may be removed.
- Feature Restriction: Access to specific features (messaging, video uploads) may be restricted.
- Account Suspension: Suspension, for a set time or until GigNGo reviews it, for serious or repeated violations. A suspended account may be unable to post, apply, or send messages, and its open job posts may be taken down.
- Account Termination: Permanent removal from the Platform for severe violations or repeat offenders, such as fraud or scams. GigNGo may disable sign-in for the account, take down its posts, and refuse new accounts that use the same email address or phone number.
12.4 Appeal Process
If you believe an enforcement action was taken in error, you may appeal by contacting [email protected] with your account information, description of the enforcement action, explanation of why you believe it was erroneous, and any supporting evidence or documentation. Appeals will be reviewed within 5-10 business days. GigNGo's decision on appeals is final.
12.5 Reporting Violations
Users can report violations of these Terms by using the "Report" button on content (videos, profiles, job postings), sending an email to [email protected] with details and evidence, or using the in-app reporting feature in the messaging system. All reports are reviewed, but GigNGo cannot guarantee a response to every report or that action will be taken.
13. International Use
13.1 Platform Availability
GigNGo is operated from the United States. The Platform is available internationally through the Apple App Store. By accessing or using the Platform from outside the United States, you agree that these Terms, governed by Michigan law, apply to your use of the Platform regardless of your country of residence.
13.2 Compliance with Local Laws
You are solely responsible for ensuring that your use of the Platform complies with all laws and regulations applicable in your country or jurisdiction, including but not limited to laws governing gig work, labor classification, payments, and data privacy. GigNGo makes no representation that the Platform is appropriate or legally available in all locations.
13.3 Contractor Classification — International
All Locals using GigNGo are independent contractors globally, not employees of GigNGo. Different countries have different laws governing the classification of people who work through digital platforms. It is the responsibility of each Local and Client to understand and comply with applicable labor, tax, and employment laws in their jurisdiction. GigNGo does not provide legal or tax advice.
13.4 Sanctions and Restricted Jurisdictions
GigNGo complies with applicable US export control and sanctions laws and regulations, including those administered by the US Department of the Treasury's Office of Foreign Assets Control (OFAC). You may not use the Platform if you are located in, or a national or resident of, any country or territory subject to comprehensive US sanctions, including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine.
13.5 Dispute Resolution for International Users
International users agree that any disputes with GigNGo shall be resolved under Michigan law and through AAA arbitration as described in Section 9.2, to the maximum extent permitted by the laws of their jurisdiction. Users in the European Union should note that mandatory consumer protection laws of their member state may apply alongside these Terms.
